Do I have to take the settlement insurance is offering me?

Were you injured in a car accident in South Carolina? Has the responsible party's insurance provider offered you a settlement you feel is insufficient? Guess what, you don't have to take it?

Here's the deal with car accidents. It is in the best interests of insurance providers to offer low, quick settlements. This saves them time and money. While it can be tempting to take this quick settlement, it may not be in your best interest to do so -- even if you really feel you need the money now. 

Following a crash

After your collision you did what you were supposed to do: you reported it. The insurance provider of the allegedly responsible party got involved and opened an investigation. They agreed to pay out enough to fix your car and cover some of your medical bills, but not everything. You feel that if you reject the terms of their offer, you'll lose out on compensation altogether, yet you struggle to agree. 

Following a crash with injuries, you are vulnerable. You've been through a lot. You are in pain, the bills are piling up and you have more stress in your life than you feel you can handle right now. Insurance companies know this and bank on you taking their initial offer because of it. You can say no, and you can demand more. This you usually have to do in writing. The insurance provider will look over your demands and choose whether to approve your request. 

Settlement negotiations

If insurance refuses your request, it does not mean all hope is lost. This is just the beginning of the settlement negotiation process. There may be a lot of back and forth, and it can take time to reach agreeable terms, but it is possible to do so. 

If negotiations fail, again, this does not mean you have to take their meager settlement. If thought appropriate, you may take the matter to trial in an attempt to seek fair and full compensation for your losses. 

Timeline

When it comes to seeking a fair settlement, there really is no timeline for how long it might take. Some cases can close relatively fast while other may take awhile. At the end of the day, you have to keep focus on what you are trying to achieve. You suffered injuries because of another person's negligence. Your life was turned upside down. You have every right to seek maximum relief for your losses.
